Deborah. Aslak Berg The budget rebate is secondary law which has been replaced, but the opt outs from the single currency, Schengen and Justice and Home Affairs law are still in protocols attached to the Treaties, which have not been repealed or amended. So prima facie they would apply again.

🚨🚨There is a good legal argument for this. The protocols are primary law. Another thing would be to what extent they legally would still be applicable in respect of UK after . The protocols were written as if the UK would be still an EU member. 👇👇
